L1 Visa Time Frame

The L1 visa is a US visa used for a multinational organization and includes mainly workers for the intra company transference. As required sometimes the company migrates an employee is expertise and for this the organization needs to submit a petition for an L1 visa to the USCIS (United States Citizenship and Immigration Service) and further to the change of status (COS).
Following are the candidates who are meant to be eligible to make an appeal for the COS in the United States-


  The applied candidate must have been officially nominated for migration on the temporary basis for the U.S. as a non-immigrant applicant
•    Since the applicable candidate applies for the temporary migration, they must not commit any act which makes them not qualified to receive the benefits of immigration
•    The applicant must request an L1 extension relating to the change of status before the ending date of their I-94.

It is also known as the “dual intent” visa as the L1 visa holder may apply for the permanent residency for USA and they do have to establish ties to their home countries. According to USCIS, the L1 petition processing time frame is about 2 to 3 months and after receiving the L-1 approval notice from the USCIS the applicant may submit a visa application for L-1 at local consulate for stamping.


Steps to get the L1 visa-

•   A petition for non-immigrant worker will be filed with USCIS under L-1 category. In certain cases, a request for evidence is required, which means that the officer adjudicate the formal request needs a verification before proceeding to the final and make the final decision.
•    Once the request is approved by an officer at USCIS, then a visa application is submitted at the local consulate for stamping.
    The visa interview is conducted by the consular office.
•    Once the interview is passed, the candidate gets the visa in a very short time span.
In the steps as mentioned earlier, the documentary evidence takes maximum time. Get prepared for the L1 visa at least 2 to 3 months before and migrate successfully.

Conclusion:

L1 visa processing has a time frame of minimum 2-3 months. It includes few steps of Petition and visa interview. After the visa stamping, the candidate becomes eligible to get a visa and the same is issued to them in a very short time span.

I have valid L1B visa till July 2016 & I am currently in USA, when my company applies for extension before 3 months and when my extension got approved, Should I visit back to my country for stamping? or does COS (I 94 status) will get changed automatically with the approved extension? to be simpler - Should I work in USA with approved extension papers?
